1. Agreement
These Terms of Use (“Terms”) are a legal agreement between you and ProgramU LLC, a Wyoming limited liability company doing business as HER TRUTH (“HER TRUTH,” “we,” “us,” or “our”). These Terms govern your use of the website at hertruth.app, the booking of any session or live gathering, and the purchase of any digital program (together, the “Services”). By using this website, booking a session, or purchasing a program, you agree to these Terms. If you do not agree, please do not use the Services. Questions: hello@hertruth.app.
2. Important disclaimers — read before booking
HER TRUTH offers coaching, embodiment, and personal-development work. Before engaging with any of it, understand the following: • Not medical or mental health care. HER TRUTH sessions, gatherings, and programs are NOT therapy, medical care, psychological or psychiatric treatment, or a substitute for any of those. Kaylee is not a licensed physician, psychologist, therapist, or dietitian, and nothing in the Services constitutes medical advice, diagnosis, or treatment. • Not professional advice. Nothing in the Services constitutes financial, legal, or other professional advice. Consult qualified professionals for matters requiring expert guidance. • Somatic and embodiment work. Sessions and gatherings may include breathwork, movement, and self-applied bodywork practices that you perform on your own body, guided verbally. Participation is voluntary at every moment, and you are always free to modify or skip any practice. See the Session Consent & Liability Waiver for full details — you must agree to it before booking. • Emotional intensity. Identity, embodiment, and energetic work can surface strong emotions, memories, and physical sensations. This is a normal part of the work, and it also means the work is not appropriate for every person at every time. If you are in active mental health crisis or treatment, consult your provider before booking. • No guaranteed outcomes. Every woman’s experience is her own. We make no promises of specific results — emotional, physical, financial, or otherwise. Experiences or results described by other participants are theirs alone and are not typical, promised, or predictive of yours. • Adults only. The Services are for adults 18 years of age and older.
3. What the Services are
• One-to-one sessions (such as the Clarity Call, Energetic Precision sessions, and mentorship) — private coaching and embodiment sessions held over video call, booked through our scheduling system. • Live gatherings (such as MOTHER and CREATRIX) — group sessions held live over video conference, which may be recorded and made available to participants as a replay for a limited time. • Digital programs (The Vault) — self-paced programs, series, and audio/video content purchased once and accessed on your own time. • Free content — podcasts, videos, and writing available on this site and on connected platforms (Spotify, Apple Podcasts, YouTube), governed additionally by those platforms’ own terms.
4. Booking, payment, and refunds
Booking. Sessions are booked through our scheduling provider (Cal.com) and paid at the time of booking through our payment processor (Stripe). Prices are shown before you pay. All prices are in U.S. dollars. We may change prices at any time; the price shown when you book or purchase is the price that governs that transaction. High-ticket programs. Extended engagements (such as the Energetic Precision Mentorship) may be governed by a separate written agreement covering payment schedule, term, and program-specific terms. Where a separate signed agreement exists, it controls over Section 4 of these Terms for that engagement; these Terms otherwise continue to apply. Rescheduling and cancellation for 1:1 sessions: you may reschedule or cancel a session up to 24 hours before its start time using the link in your confirmation email. Sessions cancelled with at least 24 hours’ notice are refunded in full or rebooked, your choice. Sessions cancelled less than 24 hours before start, or missed without notice, are not refunded — though if a genuine emergency pulls you away inside that window, write to us at hello@hertruth.app: we are human, and we will always look at it with care, at our discretion. Live gatherings (MOTHER, CREATRIX): your place is confirmed on payment. If you cannot attend live, the replay is included for the stated replay window. Because attendance is transferable to the replay, gathering payments are not refundable and not transferable. If we ever cancel a gathering outright, you are refunded in full, automatically. Digital programs: all sales are final. Digital program purchases are not refundable, whether or not the content has been accessed. If something is wrong with your access, write to us and we will make it right. Late arrival and technology: a 1:1 session is held for you for 15 minutes past its start time; arriving later than that is treated as a missed session. You are responsible for your own device, connection, and environment — a session lost to a failure on your side is treated as attended, though where a session is cut short by circumstances truly beyond your control, we may at our sole discretion refund or credit the undelivered portion. A session disrupted by a failure on our side is rebooked in full or refunded, your choice. Payment disputes: you agree to contact us at hello@hertruth.app about any billing issue before initiating a card dispute, and to give us five business days to resolve it. Booking records, your timestamped consent, confirmation emails, and attendance records constitute proof of authorization and delivery, and we contest unwarranted chargebacks with them. If we materially change these policies, the version shown at the time of your purchase governs that purchase.
5. Session recordings
Live gatherings may be recorded (audio and video) so the replay can be provided to participants. By joining a live gathering you consent to being recorded to the extent your camera, microphone, or chat activity appears in the recording. You may keep your camera and microphone off during group sessions if you prefer not to appear. CREATRIX circles carry a 30-day replay window; the activation meditations included with a CREATRIX seat are yours to keep. 1:1 sessions are recorded so that your session can be sent back to you as your personal replay — so you can return to the work again on your own time. You are told at the start of every session that recording is on, and if you prefer a session not be recorded, say so at any time and it will not be. Replays and recordings are licensed to participants for personal use only and may not be shared, redistributed, or republished.
6. Consent & waiver required
Before booking any session or gathering, you must review and accept the Session Consent & Liability Waiver (available at hertruth.app/consent). The waiver is incorporated into these Terms by reference. Booking a session with the consent box checked constitutes your electronic signature on the waiver, recorded with a timestamp.
7. Your conduct
You agree to: provide accurate information when booking; attend sessions sober and in a private, safe environment; treat other participants in group spaces with respect; keep what other women share in group spaces confidential; and not record, screenshot, or share any session or gathering except as expressly permitted. We reserve the right to end a session or remove a participant from a gathering — without refund — for conduct that is abusive, unsafe, or disruptive to the space.
8. Intellectual property
All content on this website and in the Services — writing, poems, audio, video, session structures, program materials, imagery, the HER TRUTH name and gem mark — is owned by ProgramU LLC (d/b/a HER TRUTH) and protected by copyright, trademark, and other intellectual property laws. Purchased digital programs and replays are licensed to you for personal, non-commercial use only. You may not reproduce, redistribute, resell, teach from, or commercially exploit any HER TRUTH content without written permission.
9. Third-party services
The Services rely on third-party providers — including Cal.com (scheduling), Stripe (payments), Zoom or Google Meet (video sessions), Vercel (website hosting), and podcast/video platforms. Your use of those services is additionally governed by their own terms and privacy policies. We are not responsible for outages or failures of third-party services, though we will always work with you in good faith to rebook anything a technical failure disrupts.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: ProgramU LLC, its members, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, or data; or personal injury or emotional distress arising from your voluntary participation in sessions, gatherings, or programs, except where caused by our gross negligence or willful misconduct. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain liability limitations, in which case the above applies to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless ProgramU LLC, its members, officers, employees, and contractors from claims, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Services, your violation of these Terms, or your violation of any third party’s rights.
12. Dispute resolution and arbitration
Any dispute arising out of or relating to the Services or these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, taking place in Sheridan, Wyoming, or by videoconference at the arbitrator’s discretion. Class action waiver: YOU AND PROGRAMU LLC AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. Exceptions: either party may seek injunctive relief in court for intellectual property violations, or pursue claims in small claims court where jurisdictionally appropriate. Opt-out: you may opt out of this arbitration agreement by written notice to hello@hertruth.app within 30 days of first agreeing to these Terms.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law provisions. Any matters not subject to arbitration shall be brought exclusively in the state or federal courts of Sheridan County, Wyoming.
14. Changes to these Terms
We may revise these Terms from time to time. Material changes will be posted at hertruth.app/terms with a new “Last Updated” date. The version in effect when you book or purchase governs that booking or purchase. Continued use of the Services after changes take effect constitutes acceptance.
15. Miscellaneous
These Terms, together with the Privacy Policy and the Session Consent & Liability Waiver, are the entire agreement between you and ProgramU LLC regarding the Services, and supersede any statement made anywhere else — no social media post, podcast, video, or conversation modifies them. If any provision is held invalid, the rest remains in effect, and the invalid provision is enforced to the maximum extent permitted. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to a successor entity. Neither party is liable for delays caused by events beyond reasonable control. Survival: Sections 5, 7, 8, and 10 through 13, and the release in the Session Consent & Liability Waiver, survive any termination of these Terms or completion of the Services.
